1. Introduction & Acceptance of Terms
These Terms & Conditions (the "Terms") govern your use of the website africavirtualnumbers.com (the "Site"), the customer portal at https://lk.africavirtualnumbers.com (the "Portal"), and the virtual telephone-number services described below (together, the "Service"). The Service is operated by AVN Telecom S.A.S. ("AVN Telecom SAS", "we", "us", "our"), a société par actions simplifiée incorporated in France, registered at 15 Rue de la Banque, 75002 Paris, France (SIREN 824 512 336, RCS Paris).
By creating an Account, renting a Number, or otherwise using the Service, you confirm that you have read, understood and accept these Terms. If you do not agree, you must not use the Service. These Terms should be read together with our Privacy Policy, Refund Policy and Cookie Statement, each of which forms part of your agreement with us.
2. Definitions
- "Account" means the registered profile you create in the Portal to access and manage the Service.
- "Number" means any virtual telephone number (voice, SMS, SMS-registration, toll-free or disposable one-time number) that we make available to you.
- "Content" means any message, call, data or material you send, receive or transmit through the Service.
- "Third-Party Platform" means any service, application or network operated by a party other than us — for example WhatsApp, Telegram, messaging apps, cryptocurrency exchanges, banks, social networks and telecommunications carriers.
3. Eligibility & Account Responsibilities
You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Service. If you use the Service for an organisation, you represent that you are authorised to bind it to these Terms.
You are responsible for keeping your Account details accurate, keeping your login credentials confidential, and for all activity under your Account. Please notify us promptly at [email protected] if you suspect unauthorised use of your Account. We may require identity or contact verification where reasonably necessary for security or legal compliance.
4. Description of the Service
The Service lets you rent virtual telephone numbers with an Africa-first focus, alongside international (US, UK and EU) numbers, and send and/or receive calls or SMS depending on the number type. Numbers are self-provisioned by you through the Portal. Available number types, capabilities, coverage and live pricing are shown on the product pages under /services/ and /countries/. We may change features, number types or coverage over time.
5. Number Allocation & Rental
Numbers are rented, not sold. You do not acquire ownership of, or any permanent right to, any Number. A specific Number is not guaranteed: subject to operational, regulatory and carrier constraints, we may rotate, change, reassign or reclaim a Number, and a Number that has expired or been released may be reallocated to another user.
- A Number is made available for the rental period you select.
- On expiry, non-renewal, or where required by a carrier or regulator, a Number may be released, and you may lose access to it and to any associated messages or data.
- Do not rely on retaining a particular Number where losing it would cause you loss — for example, as a sole account-recovery contact.
6. Acceptable Use
You agree to use the Service only for lawful purposes and in compliance with all applicable laws. In particular, you will not:
- use a Number for fraud, impersonation, phishing, spam, unsolicited bulk messaging, harassment, or the transmission of illegal, abusive or infringing Content;
- use the Service in breach of the terms, policies or acceptable-use rules of any Third-Party Platform on which you use a Number;
- attempt to circumvent the security, identity-verification or anti-abuse measures of any platform, carrier or authority;
- interfere with, overload or disrupt the Service or its infrastructure; or
- resell, sublicense or otherwise make the Service or any Number available to third parties without a separate written agreement with us.
7. Third-Party Platforms
Third-Party Platforms are outside our control. Whether a platform accepts, verifies, restricts, blocks or bans a Number is entirely the platform's own decision and may change without notice. We cannot guarantee that any Number will be accepted by, or continue to work with, any particular platform, and any such block or ban is not a failure of the Service. Your relationship with each Third-Party Platform is governed by that platform's own terms.
8. Pricing, Payment, Cryptocurrency & Taxes
Prices for Numbers and related services are shown live on the product pages and may change over time; the price applicable to an order is the one shown when you place it.
We accept a range of payment methods, including cryptocurrency. You acknowledge that crypto and certain other payment transactions are generally irreversible: once a crypto payment is confirmed on the relevant network, it cannot be recalled by us. You are responsible for sending payment to the correct address and network. Unless stated otherwise, prices may exclude applicable taxes, duties and levies, which are your responsibility other than taxes on our own income. Refund eligibility is governed by our Refund Policy.
9. Subscriptions, Renewal, Expiry & Cancellation
Some Numbers and plans are offered on a recurring or fixed-term rental basis. Where a rental is set to renew, it will renew for successive periods at the then-current price unless you cancel before the renewal date through the Portal.
If a rental expires, is cancelled, or a renewal payment fails, the associated Number may be suspended and subsequently released. Cancellation does not automatically entitle you to a refund of amounts already paid, except as set out in our Refund Policy or as required by applicable law.
10. Service Availability & No Guarantee of Delivery
We aim to provide a reliable Service but do not guarantee it will be uninterrupted, error-free or always available. The Service may be affected by maintenance, upgrades, or factors beyond our reasonable control.
The delivery of SMS messages and calls depends on numerous third parties, including carriers, aggregators, networks and Third-Party Platforms. We therefore do not guarantee that any given message or call will be delivered, received, or delivered without delay.
11. Intellectual Property
The Site, the Portal, and all software, text, graphics, logos and other materials we provide (excluding your Content) are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable and revocable licence to use the Service in accordance with these Terms. You may not copy, modify, distribute, reverse-engineer or create derivative works from any part of the Service except as permitted by law.
12. Suspension & Termination
We may suspend or terminate your access to the Service, with or without notice, where we reasonably believe you have breached these Terms, your use poses a security, legal or reputational risk, or suspension is required to comply with law or a carrier or regulator's requirement. You may stop using the Service and close your Account at any time through the Portal or by contacting us. On termination, your right to use the Service and any allocated Numbers ceases, and Numbers may be released. Provisions that by their nature should survive termination will continue to apply.
13. Disclaimers of Warranties
To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that any Number will be accepted by any Third-Party Platform or that messages or calls will be delivered. Nothing in these Terms excludes any right that cannot lawfully be excluded, including mandatory consumer-protection rights.
14. Limitation of Liability
To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business, arising out of your use of, or inability to use, the Service — including any block or ban imposed by a Third-Party Platform, any failure to deliver a message or call, or the loss or reclamation of a Number. To the extent our liability may lawfully be capped, our total aggregate liability relating to the Service will not exceed the amount you paid us for the Service in the period reasonably connected to the claim. Nothing in this section limits liability that cannot be limited under applicable law, including for death or personal injury caused by negligence, for fraud, or any mandatory consumer rights.
15. Indemnification
You agree to indemnify and hold harmless AVN Telecom SAS and its officers, employees and agents against any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of your use of the Service, your Content, your breach of these Terms, or your violation of any law or of any Third-Party Platform's terms.
16. Changes to the Service and to These Terms
We may update, improve, modify or discontinue any part of the Service, and may amend these Terms from time to time — for example to reflect changes in law or our operations. Where changes are material, we will take reasonable steps to notify you, such as by posting the updated version on the Site or via the Portal. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
17. Governing Law & Dispute Resolution
These Terms, and any dispute or claim arising out of or in connection with them, are governed by French law. The courts of Paris, France will have jurisdiction over any dispute. If you are a consumer, this does not deprive you of the protection of the mandatory consumer-protection rules of the country where you are habitually resident, and you may be entitled to bring proceedings in your local courts. We encourage you to contact us first so we can try to resolve any concern amicably.
